Terms of Service

By creating an account or using AvoirWealth (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and AvoirWealth Inc. ("AvoirWealth," "we," "us," or "our"), a corporation registered in British Columbia, Canada.

AvoirWealth is a personal finance dashboard that allows you to import, organize, and visualize your financial data, including net worth, investment portfolio, and budget, in one connected interface.

The Service is a personal financial organization tool. It helps you see and understand your own financial data. It is not a bank, brokerage, investment advisor, or financial planning service.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes that affect paid subscribers.

To use AvoirWealth, you must be at least 18 years old and a resident of Canada. By using the Service, you represent that you meet these requirements.

AvoirWealth is designed for personal, non-commercial use. Use of the Service on behalf of a corporation, partnership, or other entity requires our prior written consent.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@avoirwealth.com if you suspect any unauthorized access to your account.

You may not share your account with others or create accounts on behalf of third parties without authorization.

You must provide accurate and current information when creating your account and keep that information up to date.

AvoirWealth offers both a free tier and paid subscription plans. Paid plans are billed on a monthly or annual basis as selected at the time of purchase. All prices are in Canadian dollars (CAD) and include applicable taxes.

Cancellation. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial periods.

Refunds. If you believe you have been charged in error, contact us within 14 days at support@avoirwealth.com and we will review your request.

Price changes. We will provide at least 30 days' notice before increasing the price of your subscription. You may cancel before the new price takes effect.

Free trial. If we offer a free trial, your subscription will automatically convert to a paid plan at the end of the trial period unless you cancel before that date.

You retain full ownership of all financial data and content you import into or create within AvoirWealth. We do not claim any ownership over your data.

By using the Service, you grant AvoirWealth a limited, non-exclusive license to store, process, and display your data solely for the purpose of providing the Service to you. This license ends when you delete your account.

You are responsible for ensuring that the data you import is accurate and that you have the right to use it. We are not responsible for errors, omissions, or inaccuracies in data you provide.

You may export or delete your data at any time. Upon account deletion, your data will be permanently removed within 30 days in accordance with our Privacy Policy.

AvoirWealth is not registered as an investment advisor, portfolio manager, or financial planner under any provincial or federal securities legislation in Canada. We are not regulated by the Canadian Investment Regulatory Organization (CIRO), the Ontario Securities Commission, the British Columbia Securities Commission, or any equivalent body.

All data displayed in AvoirWealth, including portfolio returns, net worth figures, and budget calculations, is derived from information you have provided. This data is for your personal reference and organizational purposes only.

Before making any financial, investment, or tax decision, you should consult a qualified financial advisor, investment advisor, or tax professional who is registered and licensed to provide such advice in your jurisdiction.

We make no representations or warranties regarding the accuracy, completeness, or suitability of any data displayed in the Service for any financial decision-making purpose.

You agree to use AvoirWealth only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to gain unauthorized access to any part of the Service, our systems, or other users' accounts
• Introduce any malicious code, virus, or other harmful content
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Reproduce, resell, or commercially exploit any part of the Service without our written permission
• Provide false or misleading information during account creation or use
• Use automated tools to scrape, crawl, or extract data from the Service

Violation of these terms may result in immediate termination of your account.

AvoirWealth and all of its components, including the software, design, trademarks, logos, and content created by us, are owned by AvoirWealth Inc. and are protected by applicable Canadian and international intellectual property laws.

Nothing in these Terms grants you any right to use our trademarks, logos, or brand assets without our prior written consent.

Your feedback and suggestions are welcome. If you share ideas or suggestions with us, you grant us the right to use them without compensation or obligation to you.

To the fullest extent permitted by applicable law, AvoirWealth Inc. and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service.

This includes, but is not limited to, losses resulting from financial decisions made in reliance on data displayed in AvoirWealth, inaccuracies in imported data, interruptions in service availability, or unauthorized access to your account despite reasonable security measures.

Our total liability to you for any claim arising from these Terms or your use of the Service will not exceed the amount you paid us in subscription fees in the three months preceding the claim.

Some jurisdictions do not allow certain limitations of liability. In such cases, our liability will be limited to the maximum extent permitted by law.

You agree to indemnify and hold harmless AvoirWealth Inc. and its officers, directors, and employees from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your violation of these Terms, your use of the Service, or your violation of any third-party rights.

You may close your account at any time from your account settings. Upon closure, your data will be deleted within 30 days.

We may suspend or terminate your account at any time if we determine you have violated these Terms, engaged in fraudulent activity, or if we are required to do so by law. We will provide notice where reasonably possible.

Upon termination of a paid subscription due to a violation of these Terms, you will not be entitled to a refund of any prepaid fees.

Sections 7, 9, 10, and 11 survive the termination of these Terms.

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Service that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of British Columbia, Canada.

We encourage you to contact us first at support@avoirwealth.com before initiating any formal proceedings. Most issues can be resolved quickly.

We may update these Terms from time to time. When we make material changes, we will notify you by email at least 14 days before the changes take effect and update the "Last updated" date at the top of this page.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those terms. If you do not agree to the revised terms, you should cancel your account before they take effect.
